Terms and Conditions

1) Overview and acceptance

These Terms and Conditions (“Terms”) govern your use of Junksterbag’s outdoor-only junk and debris pickup services and the https://junksterbagpickup.com/ website (collectively, the “Services”). By booking, paying for, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2) Who we are and service scope

Junksterbag provides curbside, ground-level pickup and haul‑away of non‑hazardous junk and debris across New England. Service availability, pricing, item eligibility, and timing may vary by location and season.

3) Outdoor‑only service and access requirements

Placement: Stage bags/materials curbside, in a driveway, or another outdoor, ground‑level spot with a straight, unobstructed approach and adequate overhead clearance. We do not enter homes, apartments, garages, buildings, or enclosed areas.

Timing: After you book, most pickups occur within 24–72 hours (no appointment window). You do not need to be home; materials must remain outside and accessible until collected.

Access: Keep gates unlocked; move vehicles from the loading area; ensure level, firm ground; confirm overhead clearance (watch for trees, wires, and awnings). Unsafe or blocked conditions may be declined or rescheduled at our discretion.

4) Surfaces and driveway protection

You are responsible for selecting and protecting staging surfaces (concrete, asphalt, gravel, grass). Where risk of scuffs/ruts exists—e.g., hot asphalt, pavers/stamped concrete, gravel, or grass—use 3/4‑inch exterior‑grade plywood to distribute loads and minimize cosmetic marks. Pickup may be declined if conditions are not reasonably safe or accessible.

5) Materials we accept and restrictions

Acceptable: Bagged construction debris; renovation waste (drywall, lumber, tile); roofing shingles; carpet/flooring; small furniture; yard waste; and similar non‑hazardous items. Appliances must be empty and fully disconnected; additional handling or regulatory fees may apply for certain items.

Prohibited: Hazardous waste, liquids, oils, fuel/propane, paint (unless fully solidified), chemicals, batteries (unless pre‑approved), medical/biological waste, asbestos, and any item restricted by law. We may refuse items at pickup if unsafe, prohibited, or not staged per these Terms.

6) Booking, pricing, and payment

Quotes/estimates: Online prices are based on standard conditions and item types/sizes. Final charges may adjust for overflow, overweight, special handling, re‑bagging, additional distance, or site constraints.

Payment: You authorize us (and our payment processors) to charge your card or chosen method for quoted amounts and any approved adjustments. Taxes, disposal, and regulatory fees may apply.

Title transfer: Title to accepted items transfers to us upon loading. We may recycle, de‑manufacture, donate, resell, or dispose of items in our discretion, consistent with law.

7) Cancellations, rescheduling, and failed access

Cancellations: Cancel or reschedule before we dispatch at no charge. A fee may apply once a crew is en route or on site.

Failed access: If we arrive and items are missing, inaccessible, prohibited, not staged outdoors, or conditions are unsafe, a trip or re‑attempt fee may apply.

8) Permits, HOAs, and urban placements

You are responsible for any permits, approvals, or HOA authorization required for curb/street or common‑area staging. Follow local rules for sidewalk clearance, ADA access, hydrants, and loading zones. See placement guidance on our website: https://junksterbagpickup.com/

9) Recycling, donation, and environmental practices

We prioritize responsible recycling, de‑manufacturing, and donation when possible; availability varies by material, condition, and facility capacity. Donation receipts are not guaranteed.

10) Property condition and limited responsibility

Normal operation of trucks, stabilizers, and lifting equipment can leave temporary impressions or cosmetic marks on soft or delicate surfaces. By using the Services, you acknowledge and accept these ordinary risks and agree to prepare/protect surfaces as needed. Our liability for property damage is limited as set out in Section 13.

11) Weather, safety, and delays

For safety, we may delay or reschedule service due to weather, road closures, site hazards, or events beyond our control. We are not responsible for consequential losses from delays.

12) Your responsibilities

You represent and warrant that you have authority to stage items at the service location and to transfer title for removal; that staged items and site conditions comply with these Terms and applicable law; and that information you provide (location, contact, items, access notes) is accurate and complete.

13) Disclaimers; limitation of liability

Except as expressly stated, the Services are provided “as is” and “as available.” To the maximum extent permitted by law, Junksterbag disclaims all warranties, express or implied, including merchantability, fitness, and non‑infringement. Junksterbag and its owners, employees, and contractors will not be liable for any indirect, incidental, special, punitive, or consequential damages; our total liability for any claim is limited to the amount you paid for the applicable Service.

14) Indemnification

You agree to defend, indemnify, and hold harmless Junksterbag from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Services, or your negligence or willful misconduct.

15) Photos, recordings, and communications

We may take before/after photos or short video clips of the staging area and items for proof of service, quality assurance, safety, training, or customer support. We may contact you by email, phone, or SMS regarding your booking; you can opt out of marketing SMS at any time by replying STOP (message/data rates may apply).

16) Changes to Terms

We may modify these Terms at any time by posting an updated version on this page of our website: https://junksterbagpickup.com/ Continued use of the Services after the effective date constitutes acceptance of the updated Terms.

17) Governing law and venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict‑of‑law rules. Exclusive venue for disputes is the state or federal courts located in Essex County, Massachusetts, and you consent to personal jurisdiction there.

18) Severability; waiver

If any provision is held invalid, the remaining provisions remain in full force. Failure to enforce a provision is not a waiver of the right to do so later.
